By accessing or using our website [ www.serik.ca  ] ( the “Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please refrain from using our Site. 

1. Introduction  

Serik Realty operates an online platform providing real estate listings, market information, and related services, focusing on properties located within the  Greater Toronto Area (GTA), Ontario, Canada . These Terms govern your access to and use of the Site and any services offered therein. 

By accessing or using the Site, you confirm that you are at least eighteen (18) years of age and possess the legal capacity to enter into this agreement. 

Your use of the Site is governed exclusively by these Terms and any other policies incorporated herein by reference. 

2. Use of the Website  

You agree to use the Site solely for lawful purposes and in strict compliance with all applicable laws, regulations, and guidelines, including those governing real estate transactions in Canada. 

You expressly agree not to: 

• Post, transmit, or distribute any content that is unlawful, defamatory, fraudulent, harmful, or infringing upon the rights of others; 
• Engage in any activity that disrupts or interferes with the operation of the Site or the servers and networks connected thereto; 
• Use automated systems or software to extract data or otherwise engage in unauthorized data mining or scraping; 
• Harvest or misuse MLS® listing information provided via the Site. 

Additionally: 

• Serik Realty reserves the right to  restrict or limit access to certain areas of the Site at its sole discretion. 
• Users are responsible for maintaining the confidentiality of any access credentials provided, including usernames, passwords, or other authentication methods. 

Failure to comply with these rules may result in  account suspension, termination, or legal action . 

3. Listings and Information  

The property listings, descriptions, images, pricing, and availability information presented on the Site are provided for  general informational purposes only . 

While Serik Realty endeavors to ensure accuracy and timeliness, we  do not warrant or guarantee the completeness, accuracy, or reliability of any content or listings. 

All information is subject to change without prior notice. You acknowledge that errors or inaccuracies may exist, and  you use and view all information at your own risk . Users are advised to  independently verify all details before making any real estate decisions or commitments. 

Serik Realty is  not responsible for third-party content , including user-generated content or linked external websites. 

4. User Accounts  

Certain features of the Site may require user registration and account creation. By creating an account, you agree to: 

• Provide truthful, accurate, current, and complete information; 
• Maintain the confidentiality of your login credentials and be responsible for all activities occurring under your account; 
• Immediately notify Serik Realty of any unauthorized use or security breach relating to your account. 

Serik Realty reserves the right to  suspend or terminate user accounts in the event of violations of these Terms or misuse of the Site. 

5. Messages and Communications through the Website  

Th is Website enables users to send inquiries and messages to real estate professionals, including REALTORS®.  These communication features are provided solely for the private, non-commercial use of individuals who have a bona fide interest in purchasing, selling, or leasing real estate and who wish to obtain information regarding property listings. 

Any other use of the messaging system is strictly prohibited. 

Users agree not to use this Website to transmit any communication that is unlawful, abusive, harassing, defamatory, obscene, discriminatory, misleading, or otherwise objectionable. Prohibited content includes, but is not limited to, messages that: 

• Infringe upon or violate the intellectual property or other legal rights of any third party; 
• Contain defamatory statements or material harmful to minors; 
• Include viruses, malicious code, or other harmful technological elements intended to disrupt or damage systems or data; 
• Contain false, misleading, or inaccurate information; 
• Include sensitive personal information. 

For the purposes of these Terms, “Sensitive Personal Information” includes, without limitation: social insurance numbers, passport numbers, driver’s licence numbers, credit or debit card information, banking details, employment or financial records, health information, account passwords, dates of birth, criminal history, or information relating to an individual’s ethnic origin, religion, sexual orientation, or gender identity. 

Serik Realty is under no obligation to monitor communications transmitted through the Website; however, we reserve the right to review, restrict, or remove any message at our sole discretion, including where required to comply with applicable laws, regulatory requirements, or professional standards. 

6. Intellectual Property Rights  

All content available on the Site, including but not limited to text, images, graphics, logos, software, and trademarks, are the  exclusive property of Serik Realty or its licensors and are protected under Canadian and international intellectual property laws. 

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for  personal, non-commercial purposes only . Any reproduction, modification, distribution, or public display of Site content without prior written authorization is strictly prohibited. 

Unauthorized use may give rise to  civil claims and/or criminal prosecution under local and international law. 

7. MLS®, VOW, CREA, TRREB, and PropTX Compliance  

CREA Compliance 

• All listings on this Site are sourced from the  Canadian Real Estate Association (CREA) MLS® database. 
• Listings are provided  exclusively for personal, non-commercial use by individuals with a bona fide interest in buying, selling, or leasing real estate. 
• Users are prohibited from copying, redistributing, retransmitting, or otherwise using MLS® data outside the scope of evaluating a specific property. 

TRREB Compliance 

• The  Toronto Regional Real Estate Board (TRREB) maintains proprietary rights and copyrights over all MLS® data in the GTA. 
• You may not scrape, mine, redistribute, or sublicense listing information. TRREB and its authorized representatives may monitor VOW displays to ensure compliance with MLS® rules and policies. 

VOW (Virtual Office Website) Use 

• Serik Realty operates as an  affiliated VOW partner , providing registered users secure access to MLS® listings. 
• Personal information (name, email, phone) may be collected and shared with CREA, TRREB, or PropTX for auditing, verification, or legal purposes. 
• Any agreement creating financial obligations or representation by Serik Realty must be  established separately and cannot be accepted merely by using the Site. 

PropTX Compliance 

• Some MLS® listings may be accessed through  PropTX , which owns its MLS® database and system. 
• Users must not scrape, mine, redistribute, or manipulate PropTX listing information. 
• PropTX and authorized representatives may audit the platform to verify compliance, and your personal information may be used for this purpose. 

REALTOR® Guidelines 

• Users acknowledge that they have  read and understood the brochure “Working With a REALTOR®” and agree to abide by its principles in all interactions facilitated through the Site. 

The information provided through CREA, TRREB, VOW, or PropTX is considered reliable but  not guaranteed , and users must independently verify details before acting on them. 

8. Limitation of Liability  

To the fullest extent permitted by law, Serik Realty and its affiliates, officers, employees, agents, licensors, and suppliers disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. 

Serik Realty shall not be liable for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use or inability to use the Site, or from reliance on any content, even if advised of the possibility of such damages. 

9. Indemnity  

You agree to indemnify, defend, and hold harmless Serik Realty, its affiliates, officers, directors, employees, agents, licensors, and suppliers from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: 

• Your use or misuse of the Site; 
• Any breach by you of these Terms; 
• Your violation of any rights of third parties, including intellectual property rights; 
• Any inaccurate, misleading, or unlawful information or content that you submit or transmit through the Site. 

10. Third-Party Links and Services  

The Site may contain links to third-party websites, services, or advertisements solely for your convenience. Serik Realty does not endorse, control, or assume responsibility for the content, privacy policies, or practices of any third-party sites. 

You access such third-party links at your own risk. 

11. Privacy  

Your use of the Site is subject to our  Privacy Policy , which details how we collect, use, and protect your personal information. Please review the Privacy Policy carefully to understand our practices. 

12. Governing Law and Jurisdiction  

These Terms shall be governed by and construed in accordance with the laws of the  Province of Ontario and the federal laws of Canada applicable therein. 

Before initiating any claim, parties agree to  attempt informal resolution by contacting Serik Realty at  info@serik.ca . If the dispute is not resolved within  30 days , it shall be submitted to  binding arbitration on an individual basis in Ontario , to the extent permitted by law. 

Any unresolved disputes following arbitration shall be subject to the  exclusive jurisdiction of the courts in Toronto, Ontario . 

13. Amendments  

Serik Realty reserves the right to amend or update these Terms at any time without prior notice. Such changes will become effective immediately upon posting on the Site. 

Your continued use of the Site following any amendments constitutes your acceptance of the updated Terms.
